Introduction
We aim to always maintain ArtUK.com as a children-friendly website. We do this primarily through through self-policing. Account Holders should be clear about their responsibilities which are detailed under Use of the Website - Account Holder further down this page.

General
By using the ArtUK.com website [the Website], you [the member of public - the User], or you [the account holder listed at the Website - the Account Holder], agree to be bound by the following terms and conditions [Terms]. These Terms may be updated from time to time without notice, so check back periodically. Use of the Website after ArtUK.com has updated the Terms constitutes acceptance of the latest Terms.

The Website
The Website is an art gallery and information sharing portal for internet users. The Website provides a searchable internal database of artist or gallery records, links to external websites (i.e. Google.com), as well as other services, offered from time to time.

All content and services provided on the Website are provided in good faith on an 'as-is' basis. Whilst ArtUK.com makes every effort to ensure accuracy in the content of the Website, ArtUK.com:

  • makes no representation or warranty as to the actual accuracy of the content or the suitability or reliability of the services; or
  • is not responsible for services being made available to you.

Use of the Website - General Public
The User acknowledges that they use of the Website and any content or services listed, available or accessible through it is entirely at their own risk. By providing the User with access to content or services on or through the Website, ArtUK.com is not advising the User in any way in connection with such content or services. The User should always obtain professional advice before making any decision that may have legal, medical and financial or other personal implications.

Use of the Website - Children
ArtUK.com is concerned about the safety and privacy of all its Users, particularly children. Account Holders agree to not publish on the Website any material (text or images) unsuitable for children.

Registering on the Website - Account Holder
In order to create an album on the Website, ArtUK.com requires the main account holder to supply contact details. The Account Holder agrees to provide ArtUK.com with accurate information when applying for an account on the Website. The Account Holder also agrees to notify ArtUK.com of any changes to that information, and to ensure that their listing on the Website is as current and accurate as possible. The Account Holder agrees to receive email correspondence from ArtUK.com ... this being essential for ArtUK.com administration, support services, system update, etc.

When setting up accounts on the Website, the Account Holder chooses a password to enable access and self-update to their listing. The Account Holder is responsible for maintaining the confidentiality of their password and for all activities that occur using the password.

The Account Holder agrees to notify ArtUK.com immediately if there is any unauthorised use of their password.

The Account Holder releases ArtUK.com from any liability that may arise in connection with any use of their password whether by them or any third party.

Use of the Website - Account Holder
An Account Holder must not use the Website to transmit or display any content that:

  • is unlawful, misleading, defamatory, obscene, threatening, offensive, abusive, hateful, objectionable or pornographic;
  • is sexually explicit, vulgar, obscene or otherwise objectionable text.
  • are photographs displaying nudity. This including, but not restricted to, photographs display genital areas or breasts.
  • harasses or is harmful to another person;
  • invades another person's privacy or amounts to a breach of confidence; or
  • infringes a third party's rights (including any intellectual property rights).

The Account Holder agrees to comply with all local rules that may apply to use of the Website. The Account Holder agrees to comply with all applicable laws regarding the transmission of data from the UK.

Quality of Work - ArtUK.com wishes to maintain an extremely high quality of art work throughout the ArtUK.com website. If ArtUK.com feels the work of an Account Holder is not up to the required standard, ArtUK.com reserves the right, at their absolute discretion, to either ask the Account Holder to take down their work, or to delete the account of the Account Holder. ArtUK.com apologises in advance for any offence that such action may cause.

Account Deletion
Failure to comply with Use of the Website - Account Holder rules will result in deletion of the Account Holder account, and subsequent loss of all images and data previously uploaded by the Account Holder. We reserve the absolute right to take such action, and take all abuse reports seriously. In the event of account deletion, no refund will be offered.

Privacy Policy
Any Personal Data collected by ArtUK.com is subject to the Website Privacy Statement.

Third Party Links
The Website routinely provides links to websites operated by third parties. ArtUK.com does not control these websites and accepts no responsibility whatsoever for the activities or operations of these websites or the accuracy, copyright, compliance, legality or decency of any content or services available on these websites.

User correspondence or business dealings with, or participation in the promotions of, third parties found on or through the Website, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings (including any implied term of merchantability, satisfactory quality, fitness for a particular purpose and any term as to the provision of services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right) are solely between the User and such third parties..

Inclusion of a link to a third party's site does not imply endorsement by ArtUK.com of the third party, its site, or any goods, services or content featured on or available from that site. ArtUK.com will not be liable to the User in any circumstances for:

  • the failure of a third party to comply with the ArtUK.com listing rules ... see Use of the Website - Account Holder above;
  • any goods, services or content acquired through a third party's site; or
  • any damage, loss, cost or expense arising from the presence of a third party on the ArtUK.com or use of a third party's site.

Disclaimer
To the maximum extent permitted by law, ArtUK.com disclaims all warranties, express or implied, relating to the content or services available on or accessible through the Website, including any implied term of merchantability, satisfactory quality, fitness for a particular purpose and any term as to the provision of services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right.

To the maximum extent permitted by law and except in respect of death or personal injury arising out of ArtUK.com negligence, ArtUK.com will not be liable for any loss, damage, cost or expense of any kind incurred by the User/Account Holder arising in connection with use of, or inability to use, the Website and the User/Account Holder release ArtUK.com from all such liability.

Indemnity
The User/Account Holder indemnify ArtUK.com from and against all loss, damage, cost or expense (including legal costs) incurred in connection with use by the User/Account Holder of ArtUK.com or any breach by you of these Terms or any applicable local laws.

Intellectual Property
The User/Account Holder acknowledge that intellectual property rights subsist in the Website (including its content and services). These intellectual property rights are owned by ArtUK.com or third parties, as the case may be.

The User may print or download one copy of the content on the Website for personal, non-commercial use only. The User must not otherwise use ArtUK.com or its content or services in any way without our express permission, or the permission of the relevant third party.

Termination
ArtUK.com may at any time change, delete, suspend or discontinue, temporarily or permanently, the content or services offered on the Website and restrict or terminate access to the Website, without notice or liability.

Jurisdiction
Recognising the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the UK or the country in which you reside.
